Reasons for damage not covered by compensation

REASONS NOT COVERED BY COMPENSATION

Damages not covered by compensation

  1. Willful misconduct

  2. Normal leakage, normal loss of weight or volume or natural wear and tear of the cargo

  3. Inadequate or improper packaging or preparation

  4. Inherent defects or characteristics of the cargo

  5. Delay (excluding general average and salvage costs)

  6. insolvency or financial default of the ship's owner, manager, charterer or operator;

  7. Use of weapons or devices that utilize atomic fission and/or fusion or other similar reactions or radioactivity or radioactive materials

  8. The unseaworthiness of the vessel or barge or the unsuitability of the vessel or barge for the safe carriage of the cargo.

  9. The container or transport equipment is not suitable for the safe carriage of the cargo.

  10. Damage caused by terrorist acts (※) or any party acting with political, ideological or religious motives while cargo is in storage

  11. radioactive contamination

  12. Damage caused by cyber attacks

*Terrorist acts are those resulting from the actions of persons acting on behalf of or in collaboration with organizations that carry out activities designed to overthrow or take control of any legally or illegally established political system through the use of force or violence.

Compensation cannot be accepted or provided in the following cases:

When there is a risk of being subject to sanctions, prohibitions or restrictions based on a resolution of the United Nations, or when there is a risk of being subject to sanctions, prohibitions or restrictions under sanctions, laws or regulations relating to the trade or economy of the European Union, Japan, the United Kingdom or the United States of America.

Whether or not compensation is applicable varies depending on the case, so please be sure to contact us separately if you require compensation.
